Terms and Conditions

§1. General conditions

  1. These Regulations define the terms and conditions for the provision of services by TKTRANSLATE Translation Agency Tomasz Korab, ul. Stanisława Staszica 12/1, 38-400 Krosno, Tax Identification Number: 6842381974 (hereinafter TKTRANSLATE).
  2. TKTRANSLATE undertakes to make every effort to ensure that each translation order will be performed in accordance with the terms agreed between TKTRANSLATE and the Customer.
  3. All translation services are performed by TKTRANSLATE after a client’s written confirmation of the order (e-mail). The lack of a written order releases TKTRANSLATE from the obligation to provide a given service.


§2. Conditions for the execution of orders 

  1. The standard translation unit is a page unit comprising 1800 characters with spaces, possibly a number of words or working time, and in the case of an authenticated/certified translation by a sworn translator (the so-called sworn translation) one page unit contains 1125 characters with spaces.
  2. The basis for settlement with the Customer is the number of characters or words of the source text sent to TKTRANSLATE by the customer. The number of pages of standard translation is calculated to one decimal place, and the number of pages of certified translation is rounded up to the full page.The minimum unit of account is one page.
  3. The certified (sworn) translations are made on the basis of the submitted original, copy or sent scan.
  4. The price of translation does not include the preparation of a text for publication or its editing.
  5. If the customer wishes to use specific terminology in the translation, he is obliged to provide the appropriate glossary with the text to be translated. If such a glossary is not submitted, TKTRANSLATE reserves the right to use the correct vocabulary in the translation, possibly deviating from the wishes of the client, but in accordance with the accepted translation practice and the best knowledge in the given field.
  6. The agreed lead time does not include Saturdays, Sundays, public holidays and public holidays.
  7. In the case of orders executed in the express mode, TKTRANSLATE reserves the right to separate the order between several translators, which may entail a discrepancy in the terminology used.
  8. In the event of cancelling the translation order during its execution, the Customer is obliged to pay remuneration for the work actually performed and to reimburse other costs incurred by TKTRANSLATE in connection with the preparation for the provision of the services ordered.
  9. TKTRANSLATE undertakes to execute orders with due diligence, in particular in accordance with the accepted principles of the art of translation.
  10. TKTRANSLATE has the right to refrain from executing a given order if there is a justified suspicion that the content contained in it is illegal.


§3. Complaints 

  1. Within 14 business after delivering the translation service by TKTRANSLATE to the Customer, the Customer has the right to report the defects found in the translation service. The complaints should be reported in writing, detailing the complaints.
  2. In the event that the complaint is considered as justified, TKTRANSLATE makes a free translation in the shortest possible time agreed with the client.
  3. TKTRANSLATE is not responsible for technical errors in translation that are the result of errors in the output document.


§4. Data processing 

As of May 25, 2018 the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC ("RODO") entered into force. The administrator of your personal data is TKTRANSLATE Translation agency Tomasz Korab, Tax Identification Number: 6842381974, ul. Staszica 12/1, 38-400 Krosno/Poland, hereinafter referred to as "TKTRANSLATE".

The ultimate goal of TKTRANSLATE is to guarantee the privacy of your personal data that is provided to us as part of the process of performing our services. Your personal data is processed by TKTRANSLATE as well as by our trusted partners. TKTRANSLATE reserves the right to make changes to its Privacy Policy. Each of our client and user of our websites and other websites belonging to TKTRANSLATE is subject to the actual version of our Privacy Policy. If you do not agree with the Privacy Policy of TKTRANSLATE Translation Office, please do not visit the websites or subscribe to TKTRANSLATE mailings or use TKTRANSLATE services and products.

Data obtained by TKTRANSLATE is processed and stored for the following purposes:

  • performing the translation order or other services offered by our translation agency,
  • contact with current/potential clients of our translation agency,
  • offering our services to current and future clients,
  • checking the demand for the services of our translation agency,
  • determination, investigation or rejection of claims related to the provision of our services,
  • fulfillment of our obligations arising from legal provisions currently in force in Poland and in the European Union. 


We collect personal data in the following way:

  • providing us personally the documents/personal data,
  • entering data in inquiry/order/tender/contract/mailing forms etc.,
  • saving cookies,
  • collecting the web server logo by our hosting operator. 

Any contact with the TKTRANSLATE Translation Office in the form of e-mail/telephone/personal will be treated as a consent to the processing of personal data entrusted to us. All documents and auxiliary materials entrusted to us by the Customer are treated as confidential. At the Customer's request, TKTRANSLATE provides a separate non-disclosure agreement. You have the right to access your personal data, correct it, supplement it and delete it, as well as to submit a complaint to the President of the Office for Personal Data Protection if you consider that Your rights have been violated. You also have the right to withdraw your consent to the processing of your personal data at any time in the form of information by email/telephone or in person at our office TKTRANSLATE, ul. Staszica 12/1, 38-400 Krosno/Poland.


§5. Responsibility, copyrights, payment 

  1. Any material liability for all possible damages related to the delivery of a faulty translation by TKTRANSLATE is limited to the amount of net remuneration (excluding VAT) due for the execution of a given translation.The upper limit of liability is PLN 3,000.
  2. The compensation liability does not include errors in translations performed in express mode. The customer who orders express translation accepts the risk of translation errors. However, TKTRANSLATE is obliged to immediately remove them.
  3. The proprietary copyrights to the translation are transferred to the customer immediately after the full amount due is settled based on the VAT invoice issued for the translation order by TKTRANSLATE. 


§ 6. Other provisions 

In matters not regulated in these Regulations, the relevant provisions of the Civil Code shall apply.
